§ 38-173. Principal uses permitted subject to special conditions.

  • The following uses shall be permitted in an OS-1 district, subject to the conditions hereinafter imposed for each use and subject further to the review and approval of the site plan by the planning commission in accordance with section 38-390:

    (1)

    An accessory use customarily related to a principal use authorized by this section, such as, but not limited to: a pharmacy or apothecary shop, stores limited to corrective garments or bandages, or optical service, may be permitted;

    (2)

    Mortuary establishments, when adequate assembly area is provided off-street for vehicles to be used in funeral processions, provided further that such assembly area shall be provided in addition to any required off-street parking area;

    (3)

    Publicly owned buildings, telephone exchange buildings, and public utility offices, but not including storage yards, transformer stations, substations, or gas regulator stations;

    (4)

    One-, two- and multiple-family residential units within an office building subject to the following conditions:

    a.

    Dwelling units shall not be located below the second floor.

    b.

    Off-street parking shall be provided for each unit in accordance with section 38-380.

    c.

    Except for residential units in the downtown area described in section 38-380(11) that also comply with section 38-243(1), a minimum rear yard setback of thirty (30) feet shall be provided.

    d.

    An open space area shall be provided in accordance with the provisions of section 38-123(c).
