§ 9-2. Grant of authority.

  • (a)

    The city hereby grants to the company the right and privilege to construct, erect, operate and maintain in, upon, along, across, above, over and under the streets, alleys and public ways now laid out or dedicated and all extensions thereof and additions thereto in the city, poles, wires, cables, underground conduits, man holes and all television conductors and fixtures necessary for the maintenance and operation in the city of a community television system for the interception, sale and distribution of television.

    (b)

    The city reserves the right to require the company to place its conductors underground in all areas where electrical and telephone conductors now are or may hereafter be placed underground, and also to order the removal or relocation of poles, wires and other appurtenances, erected by the company whenever in the judgment of the council such action is in the public interest and the company shall forthwith comply with any and all instructions and directions in such matters at its own expense.

    (c)

    The company shall, at all times during the life of this franchise, be subject to all lawful exercise of the police power of the city, and to such reasonable regulations as the city shall hereafter by resolution or ordinance provide.

    (d)

    The right to use and occupy said streets, alleys and public places for the purposes herein set forth shall not be exclusive, and the city reserves the right to grant a similar use to any other person at any time during the term of this franchise.
